| Delay in Commencement of De-amalgamation |

The NSW Government has given notice to ClubsNSW and MIBC that they are now of the view new Regulations will need to be drafted and implemented to give full effect to their recently passed De-amalgamation Legislation. This Legislation provides important concessions for de-amalgamated clubs. These concessions will allow TBCC to retain all of its Poker Machine Entitlements, to be transferred by MIBC at de-amalgamation. MIBC has now been advised these new Regulations will not be finalised prior to Christmas. Therefore, to ensure TBCC is eligible to receive the concessions provided by this Legislation, the date of de-amalgamation of MIBC has been deferred from 23 December 2011 to a date to be advised. De-amalgamation will not be implemented until the new Regulations are finalised and the Legislation becomes effective. After this has occurred, the Casino, Liquor and Gaming Control Authority will be asked to approve all the licensing applications for the new club under the provisions of the new Legislation. It is anticipated the Regulations will be finalised in the early part of the New Year. Members will be advised of the new date for de-amalgamation once advice has been received that the Legislation is effective. Irrespective of the above, the AGM and election of Board of Directors of MIBC will still proceed as planned on 22 January 2012.
